Panamá's Criminal Process
The initial step of Panamá’s criminal process is the preliminary investigation, during which officials will assess whether a crime happened, gather evidence necessary for evaluating the crime, and identify the alleged perpetrator. Once the preliminary investigation is complete, officials will submit information to the public prosecutor’s office. Depending on the findings, it may move to press charges.
After this phase, the process proceeds as follows:
- The investigation: Representatives of Panamá’s Ministerio Público investigate the alleged crime further. At this juncture, it is possible in certain cases for the plaintiff (the accuser) and defendant (the accused) to settle the case under the direction of a judge.
- The intermediate phase: After investigating a case, the Ministerio Público can dismiss or formalize it. The latter will lead to an oral trial.
- The oral trial: At this hearing, the plaintiff and defendant can argue their cases before a judge.
- The compliance stage: Following the trial, the presiding judge will administer a decision and, if the defendant is found guilty, impose a sentence.
